Acceptance of these terms

By accessing or using FoxTrail, you agree to these Terms of Service. If you do not agree, do not use FoxTrail. These terms apply to the website, event browser, accounts, saved events, organizations, API keys, API usage dashboards, billing, feedback, and related services.

Who operates FoxTrail

FoxTrail is operated by Aether Fox Studio. If you have questions about these terms, contact us at support@usefoxtrail.com.

Eligibility and authority

You may use FoxTrail only if you are able to enter into a binding agreement under applicable law and only for lawful purposes. If you create an organization, manage billing, create API keys, or use FoxTrail on behalf of another person or organization, you represent that you have authority to do so.

Accounts and security

Some FoxTrail features require an account. You are responsible for providing accurate account information, keeping your credentials secure, and promptly notifying us if you believe your account, organization, or API keys have been accessed without authorization. You are responsible for activity that occurs through your account, organization, and API keys.

Organizations and members

Organization owners and administrators may manage organization settings, members, roles, API keys, usage, entitlements, and billing. Organization members may be able to view or use organization-level information depending on their role. You agree not to add users, create organizations, or manage billing for an organization unless you have permission to do so.

Event information

FoxTrail helps people discover events, but FoxTrail is not the organizer, venue, ticket seller, or registration provider for third-party events. Event details may come from public calendars, venues, publishers, chambers, libraries, community sites, and other sources. Event information may be incomplete, delayed, duplicated, changed, canceled, or inaccurate.

You should verify important details with the original source before attending, registering, paying for, or relying on an event. Organizers and third-party services control registration, tickets, refunds, accessibility, venue rules, cancellations, and event operations.

API access

FoxTrail may provide API access through free, paid, custom, or internal plans. API access is subject to authentication, organization entitlements, plan limits, rate limits, endpoint limits, and any additional restrictions shown in the dashboard, pricing page, API documentation, or a separate written agreement.

API keys are confidential. You agree not to publish, share, sell, expose, or misuse API keys. We may throttle, disable, rotate, suspend, or revoke API keys if we believe they are compromised, abused, used in violation of these terms, associated with unpaid access, or creating risk for FoxTrail or others.

You agree not to:

• bypass or attempt to bypass rate limits, authentication, permissions, or entitlement checks
• overload, disrupt, probe, scan, or attack FoxTrail systems
• use API data for spam, fraud, surveillance, harassment, unlawful activity, or deceptive products
• misrepresent FoxTrail data as official, guaranteed, complete, or created by an event organizer unless that is true
• remove source context in a way that makes event information misleading

Use of event data

You may use FoxTrail event data only in a lawful way and only as permitted by your plan, these terms, API documentation, and any written agreement with FoxTrail. When displaying event data, preserve meaningful source attribution or links when they are provided, especially where users need the original source for registration, tickets, updates, or details.

FoxTrail may change event sources, fields, schemas, endpoints, limits, and availability over time. We try to make changes with care, but these terms do not promise permanent access to any specific source, event, endpoint, field, plan, or schema unless a separate written agreement says otherwise.

Payments and subscriptions

Paid FoxTrail plans are processed through Stripe. By starting a paid subscription, you authorize recurring charges for the selected plan and billing interval until the subscription is canceled or otherwise ended. Prices, plan features, request limits, and billing intervals are shown on FoxTrail pricing, checkout, dashboard, or billing pages and may change over time.

Plan changes, upgrades, downgrades, cancellations, renewals, taxes, and prorations may be handled through Stripe and the FoxTrail billing flow. If a payment is past due, unpaid, canceled, incomplete, or otherwise unsuccessful, FoxTrail may reduce, suspend, or remove paid features, including API access above the free limits.

Payments are generally non-refundable except where required by law or where FoxTrail chooses to provide a refund at its discretion. This does not limit any rights you may have under applicable law.

Free and preview features

Free plans, developer previews, embed previews, experimental features, and early-access features may be changed, limited, or discontinued at any time. We may impose or adjust limits to protect the service, control costs, or keep the product sustainable.

Feedback and submissions

If you send feedback, source suggestions, ideas, bug reports, or similar submissions, you give FoxTrail permission to use them without restriction or compensation. Do not submit anything you do not have the right to share, and do not submit confidential, unlawful, infringing, or harmful material.

Prohibited conduct

You agree not to:

• use FoxTrail in violation of any applicable law or regulation
• interfere with or disrupt the operation, security, or integrity of FoxTrail
• attempt to gain unauthorized access to FoxTrail or related systems
• submit harmful, unlawful, fraudulent, infringing, or otherwise objectionable content
• misrepresent your identity, organization, authority, or relationship to FoxTrail
• use FoxTrail in a way that could harm Aether Fox Studio, FoxTrail, users, sources, organizers, or third parties

Intellectual property

FoxTrail and its content, design, branding, text, graphics, software, and other materials are owned by or licensed to Aether Fox Studio and are protected by applicable intellectual property and other laws. These terms do not grant you ownership rights in FoxTrail or its content, except for the limited right to use FoxTrail as permitted by these terms.

Third-party services and links

FoxTrail may rely on or link to third-party websites, tools, sources, payment processors, event pages, registration services, ticketing services, maps, weather data, content, or services. We do not control and are not responsible for third-party services or content. Your use of any third-party service or website is governed by that third party's own terms and policies.

Service availability and changes

FoxTrail may change over time. We may update, modify, suspend, or discontinue all or part of FoxTrail at any time, with or without notice. We do not guarantee that FoxTrail will be available at all times or that any particular feature, content, source, plan, API endpoint, schema, or functionality will continue to be offered.

Disclaimers

FoxTrail is provided on an "as is" and "as available" basis to the fullest extent permitted by applicable law. Aether Fox Studio disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that FoxTrail will be uninterrupted, error-free, secure, complete, accurate, current, or free of harmful components.

FoxTrail does not guarantee event accuracy, event availability, API availability, source availability, specific business results, or that data will meet your needs. You use FoxTrail and any event data at your own risk.

Limitation of liability

To the fullest extent permitted by applicable law, Aether Fox Studio and its affiliates, licensors, service providers, and personnel will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, data, goodwill, business opportunities, event attendance, ticket purchases, integrations, or API availability, arising out of or related to your use of or inability to use FoxTrail. To the fullest extent permitted by applicable law, the total liability of Aether Fox Studio for any claim arising out of or relating to FoxTrail or these terms will not exceed one hundred U.S. dollars (USD $100) or the amount you paid FoxTrail in the three months before the claim, whichever is greater.

Termination or suspension

We may suspend or terminate accounts, organizations, API keys, billing access, or other access to FoxTrail if we believe you have violated these terms, failed to pay amounts owed, created risk for FoxTrail or others, compromised security, abused the API, or if suspension or termination is otherwise necessary to protect FoxTrail, Aether Fox Studio, users, sources, organizers, or third parties.

Changes to these terms

We may update these Terms of Service from time to time. If we make changes, we will post the updated version on this page and update the "last updated" date above. By continuing to use FoxTrail after updated terms become effective, you agree to the revised terms.
